Transocean Deepwater, Inc., Transocean Holdings LLC, and Triton Asset
Leasing GmbH (hereinafter “Transocean”) entered into a Consent Decree with the United States
(US) to resolve the Clean Water Act (CWA) and Oil Pollution Act (OPA) claims associated with the
sinking of the Deepwater Horizon Mobile Offshore Drilling Unit (MODU) and Macondo Well oil spill
in the Gulf of Mexico. The Consent Decree required Transocean to retain an Independent
Consent Decree Compliance Auditor (the “Independent Auditor” or “IA”) to audit and report to the
US each calendar year after the date of entry.

This report was prepared by Mr. Lance Traves with Labyrinth Management Group, Inc. (LMG) as
the Independent Auditor’s annual report on Transocean’s compliance with the Consent Decree and
